Young man hit by friend: running in and out of road
Mr N a young man was standing in the road at around midnight when was struck by a Peugot 306 motor car registration driven by a friend. There was evidence that he was running in and out of the road.
He suffered a severe closed head injury, left frontal contusions and haemorrhages, and required treatment at the regional neurosurgery unit. He was unconscious for three weeks. He received rehabilitation treatment at three facilities. He underwent tracheotomy and the insertion of a PEG.
He suffers mood swings and intense outbreaks of anger. He lacks concentration and his attention wanders. He suffers from severe headaches and blurred vision.
He lacks the appropriate emotional stability and ability to persist in a task to return to employment. His ability to look after himself in terms of cleanliness, shopping and preparing food and maintaining household is impaired. His relationship with his family, previously close, has become strained.
There was a dispute in terms of the expert evidence about the severity of his cognitive brain injury.
After a trial, compensation of £511,000.00 was awarded on a 60/40 split liability (in N’s favour). The legal costs were paid by the Defendant.
Young woman brain injured crossing London street: driver uninsured
Miss B was run into by the Defendant’s car as she was crossing the road at a pelican crossing. As a result, she suffered a complex fracture to her right tibia and head injuries including bilateral frontal lobe contusions, right-sided cerebral contusions and a haematoma in the left frontal lobe.
The brain damage was severe resulting in reduced intellectual function. She will not be able to live independently, let alone work, and will require ongoing daily care and supervision for the remainder of her life. Her life expectation is normal.
The Defendant was subsequently convicted of numerous offences, including driving without due care and attention and driving without insurance.
Notice was given to The Motor Insurer’s Bureau (MIB) who dealt with the claim and paid compensation as if the Defendant had been insured.
The claim was settled for £1,800,000. The legal costs were paid by the MIB.
